We kindly ask You to read these terms and conditions carefully before ordering any Products from our website. You should understand that by ordering any Products, you agree to be bound by these Conditions of Sale (hereinafter also "Sales Terms").

Zantiago S.r.l.. may revise these Sales Terms from time to time. Any changes to the Sales Terms will apply to orders placed on after the effective date stated in these Sales Terms or elsewhere on the website https://www.zantiago.it You are therefore advised to check this page from time to time to take notice of any changes, as they are binding on You.

BEFORE PLACING AN ORDER FOR PRODUCTS, YOU MUST READ AND AGREE TO BE BOUND BY THESE SALES TERMS AND PRIVACY POLICY PROVISIONS. IF YOU FIND YOURSELF UNABLE TO AGREE TO THESE SALES TERMS AND PRIVACY POLICY PROVISIONS YOU MAY NOT PROCEED TO PURCHASE ANY PRODUCTS LISTED ON OUR WEBSITE.

1. YOUR ACCOUNT

If You create an account (personal user identification or username) on our  website - https://www.zantiago.it - You are fully responsible for maintaining the confidentiality of Your username and password and for restricting access to Your password, and You hereby agree to accept responsibility for all activities that occurs under Your account, unless those activities or purchases are carried out by an unauthorised third party who has gained access to Your account other than by reason of Your clear negligence or carelessness. It is Your responsibility to use virus checking software on any material downloaded from this Site and to ensure the compatibility of this material with Your equipment. 

In circumstances where You provide us with information relating to any third parties, You warranty that You have received that third party’s consent in relation to such disclosure and that the third party has been fully informed of and agrees to our Privacy Policy and our Cookies Policy and about the uses which we may make of such information.  You will be the sole responsible for any loss or damages we may suffer if You breach this warranty.

2. OUR BUSINESS POLICY 

Zantiago S.r.l. (the Vendor) offers products for sale on https://www.zantiago.it and its e-commerce business services are available exclusively to its end users, in other words the "Consumers", or any individual who is acting for purposes which are outside his or her/his trade, business or profession. If You are not a Consumer, please do not buy any products on Zantiago’s website and contact our commercial offices at … 

The Vendor reserves the right not to process orders received from users who are not "Consumers" and any other order which does not comply with the Vendor's business policy. These General Terms and Conditions of Sale exclusively regulate the offer, transmission and acceptance of purchase orders relating to products on https://www.zantiago.it between the Users of https://www.zantiago.it and Zantiago S.r.l. 

The Terms and Conditions of Sale do not regulate the supply of service or the sale of any product performed by third parties that are linked to our website by banners or other hypertext links. Before sending orders and purchasing products and services from those third parties, we recommend that You verify the third party's terms and conditions, since Zantiago S.r.l. shall - under no circumstances - be deemed liable for the supply of services and/or product provided by third parties or for the execution of e-commerce transactions between the users of https://www.zantiago.it and third parties.

3. ACCEPTANCE OF PLACING AN ORDER 

To be able to buy Products You must: 

• read and accept these Sales Terms and Conditions policy; 
• provide all details required in the order form, such as Your name and address, phone number, email address and phone, shipping address if different, payment details and all other information we might need to deliver the product such as an eligible delivery address; 
• be legally capable of entering into binding contracts; 

be the owner or authorized holder of a valid debit/credit card or other electronic payment.

You may purchase online on https://www.zantiago.it 24 hours a day, seven days a week. To place an order, simply click on the ADD TO YOUR CART button to place a product, and then follow the directions through the check-out process, to complete Your order. You will be provided with an opportunity to review Your order(s), read and accept these Sales Terms and Returns and Refunds Policy, check the total price of Your order(s) and the information You have provided and correct any input errors before confirming Your order(s).

Please note that unfortunately Zantiago S.r.l. currently cannot ships all around the world, so we apologise for any order we could be force to refuse because of the shipping address.

4. ORDER PROCESSING, CONTRACT FORMATION AND EXECUTION

Once you have submitted and confirmed your order(s) using Zantiago’s website, Zantiago S.r.l. will send an email to the email address You provided acknowledging receipt of Your order(s) ("Order Receipt Confirmation") and setting out details of the ordered Product(s).

A contract for the sale of Products between You and Zantiago S.r.l.  will only be formed when Zantiago S.r.l. emails You its confirmation that all, or part of the Product(s), is/are available and has/have been dispatched ("Shipment Confirmation"). Please be aware that a contract is now formed on Zantiago S.r.l. sending the Shipment Confirmation, whether or not You receive such email.

The contract for the sale of Products will relate only to those Products whose dispatch has been confirmed in the Shipment Confirmation. Zantiago S.r.l. will not be obliged to supply any other Products which may have been part of Your order until the dispatch of such Products has been confirmed in a separate Shipment Confirmation. 

Orders may be modified or cancelled before the delivery process has been initiated by contacting us by phone at +39 ….., Monday to Friday 9:00 AM to 6:00 PM, or by email at …

Once the delivery process has been initiated, orders may no longer be modified or cancelled. However, You have the option of either refusing to accept the delivery, in which case the Products will be returned to Zantiago S.r.l., or accepting the delivery and then returning the Products to Zantiago S.r.l.. in accordance with Returns and Refunds Policy. Once You have received your Shipment Confirmation, it will be too late to prevent the Products from being dispatched to you. If you would like to cancel your order after this point, please read our Return and Refunds Policy.

Zantiago S.r.l.  may choose not to accept any order in its sole discretion including, without limitation in the case of pricing errors, unusual orders and orders which Zantiago S.r.l. suspects are not placed in good faith.

5. PRICES, SHIPPING AND HANDLING

The price charged for a Product will be the price in effect at the time your order is placed and will be set out in the Order Receipt Confirmation and in your Shipment Confirmation. In the event of a pricing error, whether on the Zantiago ’s website or in an Order Receipt Confirmation or otherwise, you accept that Zantiago S.r.l. has the right to correct such error and charge the correct price or cancel the order. If the actual price is more than the amount shown on Your Order Receipt Confirmation, Zantiago S.r.l. will notify You of the correct price and give You the option of proceeding with the order or cancelling it. Your sole remedy in the event of such pricing error is to cancel Your order.

Prices for the Products include VAT and/or other applicable taxes but does not include charges for shipping. Prices for Products and for shipping and handling are liable to change at any time, but changes will not affect orders in respect of which we have already sent You a Shipment Confirmation (save in the case of a manifest pricing error as described above). 

6. PAYMENTS 

Payment for Your order, including all applicable taxes, must be made by using one of the procedures indicated on the order form, i.e. You must provide all required billing information to complete Your purchase.  You are therefore committed to submit information accurate and true and You hereby confirm that You have the right to provide and use such payment information.  

 

In case of payment by Credit/Debit Card, all details (for example, card number or expiration date) will be sent by encrypted protocol to banks and other authorized financial operators which provide remote electronic payment services, without third parties having any access thereto whatsoever. Such details will not be used by the Vendor except for performing the procedure relevant to your purchase or issuing refunds in the case of returns in compliance with GDPR and with the exercise of Your return right or for reporting cases of fraud to the police. Payment shall be made by one of the methods You have selected during the checkout process.

Please note that we accept and process most popular credits and debit cards trough Shopify platform. In the event Zantiago S.r.l. does not receive the appropriate authorization from your card or payment service provider, Zantiago S.r.l. reserves the right to reject your order.

7. TAX INFORMATION 

We remind You that purchasing on Zantiago’s website - https://www.zantiago.it - is reserved for end consumers so that our prices are always inclusive of VAT or any other applicable tax. For each order on Zantiago’s website, Zantiago issues invoice or other regular receipt. The document will be sent as an attachment in the Shipping Confirmation email. Please note that once the order has been confirmed there is no way to modify the details You have entered, and therefore it is not possible to issue a new invoice.

8. PAYMENT SECUTIRY

On Zantiago’s website, every purchase is made with maximum security thanks to the use of Shopify or PayPal payments platform (https://www.paypal.com/it/webapps/mpp/paypal-safety-and-security) which provide its services according with The Payment Card Industry Data Security Standard (PCI DSS), which is a set of industry-mandated requirements for any business that handles, processes, or stores credit cards – regardless of the business's size or location. Furthermore, the payment platform is compliant with 3D Secure 2 (3DS2), the new industry standard for customer authentication to meet PSD2’s Strong Customer Authentication (SCA) requirements.

We only use protected connections, as demonstrated by the "https" URL prefix and the lock symbol that appears in the browser's address bar. To safeguard Your credit card purchases, You will always be asked to enter your CVV code for every order. As an additional safety measure, You may be asked, by your credit card provider, to authorise payment by entering a one-time password, an SMS code, or another authentication method.

9. PRODUCT AVAILABILITY 

Zantiago S.r.l. uses all reasonable efforts to ensure the availability of Products You order from Zantiago’s website https://www.zantiago.it . However, Products are made available to purchase on a "first in-first out" basis and are only available whilst stocks last.

10. PRODUCT INFORMATION 

It’s Your own responsibility to ensure that the Products You purchase are compatible for the intended use, so please use the information on the website or Zantiago S.r.l. customer care when checking compatibility. 

Zantiago S.r.l. makes all reasonable efforts to ensure the best possible match between the product represented in the images on the website and each single shipped product, but it is always possible that there are slight differences between the displayed product and the one delivered to You, especially concerning the colours as actual colour You see will depend on Your computer system and device. Regardless this reasonable and unavoidable difference, if the Products You have received do not correspond to the ones You have ordered, or if Your delivery is incomplete or damaged in transportation, please contact Zantiago S.r.l. customer care for assistance without delay, either via email or by phone.

It might happen that Zantiago’s website contains typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, and availability. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information at any time without prior notice (including after You have submitted your order). In the event of a difference between the Zantiago’s website content and any other website, or any other source of information, the compatibility of Products as shown on the Zantiaqo’s website - at the time of purchase - will be seen as the only trustworthy and valid for the selling contract.

11. PROMOTIONS

From time to time, Zantiago S.r.l. might offer sweepstakes, contests or other promotions that require You to send material or information about yourself. Please note that sweepstakes, contests and/or promotions offered via Zantiago’s website might be, and often are, governed by a separate set of rules that, in addition to describing such sweepstakes, contests or promotions, may have eligibility requirements, such as certain age or geographic area restrictions, terms and conditions governing the use of material You submit, and supplemental disclosures about how Your personal information may be used. It is Your responsibility to read such rules to determine whether or not You want to and are eligible to participate, register and/or enter. 

By entering any such sweepstakes, contest or other promotion, You agree to comply with and abide by such rules and the decisions of any sponsor(s) identified therein, which shall be final and binding in all respects.

12. PROPERTY AND OWNERSHIP OF PRODUCTS

Ownership of the Products will pass to You only when Zantiago S.R.L. has received full payment in respect of Your order, including taxes, shipping and all other charges. Until then, Zantiago S.r.l. retains full legal title to the Products. 

The Products will be at Your own risk and responsibility from the time You take physical possession of them.

    DELIVERY

In stock products, purchased on https://www.zantiago.it are normally delivered (standard delivery) within 5 working days from the order date in Italy, and within 8 working days for all other destinations, provided that Your payment is received before 2pm on the day that the order is placed.

At present we are unable to ship orders to P.O. Boxes.

Deliveries may incur slight delays during holiday periods and couriers do not deliver on 25/12, 26/12, 01/01 or other national holiday and on weekends but products shall, in any case, be delivered within 30 days after shipping confirmation in accordance with the terms foreseen by laws in force. https://europa.eu/youreurope/citizens/consumers/shopping/shipping-delivery/index_en.htm

If for any event Zantiago S.r.l. cannot deliver your order within the period specified in Your Shipment Confirmation, Zantiago S.r.l. will notify You as soon as possible and You may choose to cancel Your order, in which case Zantiago S.r.l. will provide You with a full refund. If You unreasonably defer delivery or delay the receipt of delivery after Zantiago S.r.l. has notified You that the carrier has tried to deliver the ordered items to You, or if You have provided Zantiago S.r.l. with an incorrect delivery address which results in an unsuccessful delivery, the delivery package will be returned to Zantiago S.r.l.., Your order will be cancelled, and a full refund will be issued to You. Upon delivery, the signature confirmation by a person who is at least 18 years of age is required for all https://www.zantiago.it orders. You acknowledge that any person taking delivery of the products at the designated address shall be deemed to have done it with Your authorization.

14. RETURN AND REFUND 

If for any reason You decide not to keep Your online purchase(s), please check carefully our Return and Refund Policy and before returning the item(s), pls contact us at +39 … to obtain a Returned Merchandise Authorization (RMA) number. 

Please note that Zantiago S.r.l..will accept merchandise for a full refund, provided that item(s) is (are) in its (their) original condition and with all original packaging and enclosures. Refunds may only be issued in the same form used for payment. Merchandise must be returned within 19 days (Europe) and within 22 days (outside of Europe) from date of shipping confirmation, i.e., 14 days after Your receiving the item(s). We cannot accept returns that have been worn, used, altered, or damaged. We reserve the right to refuse return of any merchandise that does not meet the above return requirements according to Our sole discretion.

We recommend shipping returned merchandise via insured parcel post for tracking purposes as we will not assume responsibility for reimbursement or compensation if return packages are lost, stolen, or mishandled. 

All cancellations are carried out accordingly with the Italian and European Consumer Contracts Regulations, i.e., that are regulated by legislative decree No. 21 of February 21st, 2014, implementing directive 2011/83 / EU on consumer rights, and amending the previous Consumer Code under legislative decree 6th September 2005, n. 206.

15. CONSUMER WARRANTY (Guarantee)

THIS GUARANTEE GIVES YOU SPECIFIC RIGHTS. 

YOU ALSO HAVE OTHER RIGHTS UNDER LAW WHICH MAY VARY FROM COUNTRY TO COUNTRY.

Products sold by the Zantiago’s website - https://www.zantiago.it - include a guarantee for Products which turn out to be faulty or not as described during the periods set out below for various Product types:

Warranty gives You the right to request a replacement free of charge if the Products turn out to be faulty during the validity of warranty.  Refunds, if authorised, will usually be made using the same method originally used by You to pay for your purchase. This guarantee is given to the original purchaser of the Product from the Zantiago’s website - https://www.zantiago.it/ - and is not transferable, so please retain Your order confirmation/invoice or pass it on to the gift recipient as the original proof of purchase is the warranty. In case original receipt or invoice is not available, a credit card or bank statement showing the relevant transaction will suffice.

THIS GUARANTEE DOES NOT COVER NORMAL WEAR AND TEAR OR DAMAGE CAUSED BY ACCIDENTS, MISHANDLING, OR IMPROPER USE. Please carefully read the Cleaning and Maintenance recommendations you’ll find in product packaging.

You can find out all information about Your legal rights and remedies by contacting Your local consumer advice service. Zantiago S.r.l. has a legal duty to supply products that conform to the contract. Nothing in this guarantee will replace or lessen any of Your legal rights or remedies.

16. EVENTS OUTSIDE THE CONTROL OF VENDOR

Zantiago S.r.l. shall not be held responsible for any delay or failure to perform, if the delay or failure is caused by any act, event, accident or any other happening due to extenuating circumstances i.e., beyond its reasonable control, including but not limited to:

• civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war;
• strikes or lock-outs (or other industrial action);
• national or local states of emergency;
• interruption or failure of communication or transportation facilities;
• power or utility outages;
• non-performance by suppliers or subcontractors (other than by companies related to Zantiago S.r.l.);
• earthquake, fire, explosion, storm, flood, subsidence, epidemic or other natural disaster;
• impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport;
• the acts, decrees, legislation, regulations or restrictions of any government.

The time for Zantiago's performance is deemed to be extended for the period that the above continues.

17. LIABILITY

Zantiago S.r.l.  warrants to You that all Products purchased from Zantiago ’s website - https://www.zantiago.it  - is of great quality and reasonably fit for all the purposes for which such products are commonly supplied. These Sales Terms set out the full extent of the obligations and liabilities of https://www.zantiago.it  in respect of Products on sale via Zantiago’s website with the brand Zantiago. To the extent permitted by applicable law, there are no other warranties, conditions or terms that are binding on Zantiago S.r.l. other than those set out in these Sales Terms.

NEVERTHELESS, NOTHING IN THESE SALES TERMS AFFECTS ANY OF THE LEGAL RIGHTS OF CONSUMERS DESCENDING FROM EUROPEAN LAWS.

18. OBLIGATION

These Sales Terms and conditions represent the entire agreement between Zantiago S.r.l. and You and supersede any prior agreement, understanding or arrangement between the parties, whether oral or in writing. If any provision of these Sales Terms shall be deemed unlawful, void or for any reason unenforceable by any country or by any ordinary local court, then that provision shall be deemed severable from these Sales Terms and shall be enforced to the fullest extent permitted by applicable law and shall not affecting the validity and enforceability of any of other remaining provisions or of the whole contract.

19. TRANSFER OF RIGHTS AND OBLIGATIONS

These Sales Terms are binding on You and Zantiago S.r.l. and on any other legal subject to whom Zantiago S.r.l. might transfer its rights to. You may not assign your rights or obligations under these Terms to anyone. On the Contrary, accordingly with law Zantiago S.r.l. may cede, assign, or otherwise transfer its rights and obligations in terms of these Terms to third parties.

20. WAIVER

These Terms, including Privacy and Cookies Policy and Terms and Condition of Use, constitute the entire agreement between You and Zantiago S.r.l. in relation to their subject matter and supersedes any and all prior promises, representations, agreements, statements and understandings whatsoever between parties. The failure by us to exercise or enforce any right or provision of the Terms shall not constitute a waiver of such right or provision. 

21. GOVERNING LAW AND JURISDICTION

These Sales Terms and your purchase of Products from Zantiago S.r.l. website - https://www.zantiago.it - shall be governed by and construed in accordance with Italian laws, without resort to its conflict of law provisions. Any dispute or claim arising out of or in connection with these Sales Terms or your purchase of Products from Zantiago S.r.l.  (including non-contractual disputes or claims) shall be subject to the exclusive jurisdiction of the Italian courts. Related to it, the competent court shall be the Court of Milan.
